Case Overview

A noncitizen college student in Arizona who is residing in the United States on a F-1 visa, sued the Trump administration following the termination of their visa by the Department of Homeland Security.

The Application

History

The government terminated the plaintiff's SEVIS visa status pursuant to an executive action targeting such visas. The legal validity depends on whether the executive action fell within the INA's delegation of authority, whether proper notice and an opportunity to be heard were provided before termination, and whether an F-1 visa holder has a constitutionally protected interest in their status.

The Conclusion

The court determined the lawfulness of the SEVIS visa termination and the procedural protections, if any, owed to nonimmigrant visa holders subject to executive visa policy changes.
