The Conclusion
Resolved in the journalists' favor on 2026-07-23 without a merits ruling. At the hearing that day the Government VOLUNTARILY WITHDREW all challenged subpoenas, both those issued to the journalists and the third-party subpoenas, and the court declared them null and void and denied the motions to quash as moot. The court kept the matter alive in three ways: the Government must return to the court before reissuing any subpoena; the court retains jurisdiction over related matters in the investigation by consent; and the Government must produce, ex parte by July 27, its internal communications about the decision to seek a non-disclosure order, whether that application should have disclosed that the record owners were reporters, and whether and when the reporters should have been notified.
