The Application

History

Judge Immergut found that the government's federalized National Guard deployment lacked statutory authorization under the Insurrection Act and constituted a likely violation of the Posse Comitatus Act, with Oregon and other parties demonstrating irreparable constitutional harm.

The Conclusion

The district court permanently enjoined the National Guard deployment to Portland. The government appealed to the Ninth Circuit, which is now reviewing the lawfulness of the deployment and the appropriateness of the permanent injunction.
