Case Overview

Dr. Badar Khan Suri, an Indian national in the United States on a J-1 exchange visa for a postdoctoral fellowship at Georgetown University, was detained outside his home in Rosslyn, Virginia by masked ICE officers in March 2025 and told he would be deported. He and his wife had publicly opposed the war in Gaza on social media. After detaining him, the government moved him from state to state and between detention facilities over the span of a few days, without notice to his family or counsel. Suri filed a habeas petition in the Eastern District of Virginia, where he lived, was first detained, and where the first three facilities holding him were located. The government moved to dismiss, arguing the court lacked habeas jurisdiction because Suri was no longer detained in Virginia.
